General terms and conditions
This page sets out what applies to your ride with Mein Valet: from booking and price to the handover report and liability. The German version prevails.
1. Scope and contracting party
These general terms and conditions apply to all rides and additional services you book with Mein Valet: on the website, in the garage account, by WhatsApp, by phone or by email.
Your contracting party is the sole proprietorship of Marius Sucevan, trading as Mein Valet.
Mein Valet, Marius SucevanCompany number (UID): [UID]Email: info@meinvalet.chPhone and WhatsApp: 077 291 48 19Postal address: see the legal notice
The terms apply to private customers and to business customers such as garages, dealers, rental companies and fleet operators. Where a rule applies to one group only, it says so.
If a garage books the ride for its customer's car, the garage is our contracting party. The garage makes sure that the registered keeper agrees to the ride.
A customer's own terms apply only if we have confirmed them in writing.
2. Our service
We drive your car by road from one address to another: for example from you to the garage, from the garage to you, to the vehicle inspection (MFK) or from the dealer to you. A ride is the trip from the pick-up address to the destination address.
- Single ride: one ride in one direction.
- Pick-up and return: two rides, there and back.
- Inspection escort (MFK): we drive the car to the inspection centre, wait during the inspection and bring it back. Whether the car passes depends on the car. We do not vouch for the result.
- Additional services for private customers: exterior wash and interior cleaning, if you add them to your ride.
At every pick-up and every handover we record a handover report (section 9).
We take the direct route or the route that makes sense given the traffic. We do not use your car for anything else.
We drive from Monday to Saturday. On Sundays we drive on request only.
We may carry out the ride ourselves or have it carried out by our own staff.
3. What we do not do
- We do not carry passengers or luggage. We drive the car only. Neither you nor anyone else can ride along.
- We only drive cars with valid number plates and valid motor vehicle liability insurance. The car is driven on your plates or on the garage's trade plates. We do not supply plates.
- The car must be roadworthy and ready to drive. We do not tow and we do not transport cars on trailers.
- We drive passenger cars and vans that may be driven with a category B driving licence.
The driver may refuse or stop the ride if the car does not meet these requirements or the ride cannot be done safely, for example because of a warning light, worn tyres or missing winter equipment. The rule on a wasted journey then applies (section 7).
4. Booking and conclusion of the contract
You book with the form on the website, in the garage account, by WhatsApp, by phone or by email. You see the price before you send the booking.
Your booking is a binding request. The contract is concluded when we confirm the appointment: by email, WhatsApp or phone. The automatic message saying that your request has arrived is not yet a confirmation.
We may decline a request. With less than 24 hours' notice we confirm only if the ride is possible at such short notice.
The pick-up time window is agreed. The arrival time at the destination is an estimate: traffic and weather can shift it.
By booking you confirm that you are entitled to dispose of the car: as the registered keeper, or with the keeper's consent.
5. Prices and surcharges
The price that applies is the one we show you before you book or state in a quote. It is a fixed price for the ride you booked. The current price list is on the website.
The price depends on the road distance between the pick-up address and the destination address:
- zone 1, up to 10 km: included in the base price
- zone 2, up to 20 km: surcharge of CHF 40 per ride
- zone 3, up to 35 km: surcharge of CHF 80 per ride
- over 35 km: the zone 3 surcharge and CHF 2 for every further kilometre
These surcharges are added, each once per booking:
- urgent ride with less than 6 hours' notice: CHF 25
- vehicle value above CHF 100,000: CHF 20
Pick-ups from 18:00 and on Saturdays carry no surcharge.
The fixed price does not include waiting time (section 7) or expenses that are necessary for your ride and that we pay for you, for example inspection fees, parking fees, fuel or electricity. We invoice them after the ride at the amount paid, with a receipt.
If your details are wrong, for example the addresses, the time window or the vehicle value, we recalculate the price according to the price list.
All prices are in Swiss francs. We are not liable for VAT because our annual turnover is below CHF 100,000. Prices and invoices therefore show no VAT. If we become liable for VAT, we will adjust the price list and show the VAT.
Discounts and promotions cannot be combined unless the offer says otherwise.
6. Payment and late payment
Private customers pay the price at pick-up: by TWINT or in cash to the driver, or on invoice. We do not offer online payment at present.
Garages and other business customers receive one invoice per month with all rides of that month. Subscriptions and packs are invoiced in advance.
Invoices are payable within 30 days of the invoice date, without deduction.
If you do not pay on time, we send a reminder. From the reminder on you owe default interest of 5 % per year (Art. 104 of the Swiss Code of Obligations). As long as invoices remain unpaid after a reminder, we may decline further rides and suspend rides from subscriptions and packs.
Please raise any objection to an invoice within the payment period.
7. Cancellation, changes and waiting time
Cancellation by you: until the start of the booked time window you cancel free of charge, in your account, by WhatsApp, by phone or by email. Rides from a subscription or pack are credited back to you.
Changes: if you want to change the address, the date or the time window, contact us. The change applies once we confirm it. If the price changes, we tell you the new price first.
Waiting time: if the car is not ready at pick-up or nobody is at the destination to receive it, we wait. The first 15 minutes are free. After that, every 15 minutes or part thereof cost CHF 10. For the inspection escort (MFK), waiting at the inspection centre is included in the price up to 60 minutes. Beyond that, the same rate applies.
Wasted journey: we may leave if you cancel after the start of the time window, if nobody can be reached after 30 minutes of waiting, or if we cannot drive the car under section 3. We then charge the price of the ride concerned. With a subscription or pack it counts as a ride used. You may show that we incurred no cost or a lower cost.
If we cannot hand the car over to anyone at the destination, we take it back to the pick-up address or to a nearby place you name. We charge this ride as an additional ride.
Cancellation by us: we may postpone or cancel a confirmed ride if we cannot carry it out safely or on time, for example if the driver is ill or unavailable, in snow, ice or severe weather, or if roads are closed. We contact you as early as possible and propose a new date. You owe nothing for a cancelled ride. We refund what you have already paid for it. Rides from a subscription or pack are credited back. Any further claims are governed by section 11.
Stopping after pick-up: if a ride cannot be completed after pick-up, for example because of a breakdown, we agree the next steps with you straight away. You bear the cost of breakdown assistance and towing if the cause lies with the car.
8. Your obligations
You make sure that:
- the details in your booking are correct: addresses, number plate, car model, vehicle value and how we can reach you
- the car is ready at the agreed time, with the key and the vehicle registration document
- an authorised person hands over the car, someone receives it at the destination, and both sign the report
- the car is roadworthy, carries valid number plates, has liability insurance and has tyres suited to the season
- there is enough fuel in the tank or charge in the battery to reach the destination
- valuables and loose items are removed from the car before pick-up
- we know about anything unusual before the ride: known defects, warning lights, alarm, immobiliser, special controls
The car needs a valid vignette for the motorway. Without a vignette we do not use the motorway.
Garages: if the car is driven on trade plates, you are responsible for the plates, their insurance and their permitted use. You inform the registered keeper that we drive the car, record a report with photos and process data to do so.
You allow the driver to drive the car for the booked ride. If we suffer a loss because one of these obligations is not met, you are liable for it as provided by law.
9. Handover report
At pick-up and at handover at the destination the driver records a report. It contains:
- at least 10 photos of the outside of the car, plus the interior and the dashboard
- visible damage, which the driver marks on the photos
- mileage and fuel level
- time and place
- the signature of the person who hands over or receives the car
You receive the report as a PDF by email. For rides booked by a garage, the garage and its customer receive it, if we have the customer's email address.
Evidence: the report documents the condition in which the car was picked up and handed over. By signing, the person who signs confirms that they handed over or received the car and that the photos and the recorded damage show the visible condition at that moment. If you disagree with an entry, say so before you sign: we record your remark in the report.
Limits: the report records what is visible on the outside and in the interior. It is not an expert report or a technical inspection. We do not examine the underbody, the engine, the electronics or hidden damage.
Condition not verifiable: in darkness, rain or snow, or when the car is dirty, the condition cannot be assessed reliably. The report then carries the note "Condition not verifiable" with the reason. For the parts concerned it proves neither that damage was already there nor that it happened during the ride.
Software: software using artificial intelligence (AI) reads the mileage and fuel level from the dashboard photo. It can also point out possible damage. The AI is an aid, not an expert report. What counts in the report is always confirmed by a person. The report shows separately what the AI suggested and what the driver confirmed.
We store the original photos unchanged, with their capture time and a fingerprint. How long we keep them is set out in the privacy notice.
10. Reporting damage
You check for visible damage at handover and have it recorded in the report before you sign.
Damage you notice only later must be reported to us at once, at the latest within 7 days of the handover: by email to info@meinvalet.ch, with photos and a short description.
Damage reported later is deemed not to have happened during the ride, unless you prove otherwise. For damage that could not be seen at handover even with a careful check, the period starts when it is discovered.
Please do not have reported damage repaired before we have been able to look at it. You may take urgent safety measures straight away.
11. Liability and insurance
We drive your car with care and in line with the traffic rules.
Our liability is unlimited for damage we cause intentionally or through gross negligence, and for personal injury.
In the case of slight negligence we are liable for the direct damage to the car: the cost of repair, up to the current value of the car. We are not liable for other loss caused by slight negligence, as far as the law allows. This includes loss of profit, loss of use, the cost of a replacement car and the consequences of a delay.
We are not liable for:
- damage that was already there before pick-up
- technical defects and wear that are not due to our driving, for example to the engine, gearbox, clutch, battery, tyres or electronics
- damage that arises because the car was not roadworthy or your details were wrong
- valuables and other items left in the car
- force majeure and the conduct of third parties without fault on our part, for example hail, falling rocks, vandalism or theft
- the result of an inspection, repair or wash carried out by third parties
Damage to third parties: during the ride the car remains covered by the registered keeper's motor vehicle liability insurance or, on trade plates, by the garage's insurance. The Swiss Road Traffic Act requires this. If an accident was our fault, we reimburse you, under the rules of this section, for the deductible and the proven loss of no-claims bonus.
Our insurance: [VERSICHERUNG]
The same rules apply to the liability of our staff. Mandatory statutory liability is reserved in every case.
12. Fines, fees and expenses
We bear fines for traffic offences we commit during the ride. If you receive such a fine as the registered keeper, please forward it to us at once without paying it, so that we can settle it in time.
You bear fines and costs caused by the condition or the papers of the car, for example a missing vignette, an overdue inspection, defects of the car or missing insurance.
You bear inspection fees, parking fees and similar expenses that are necessary for your ride (section 5).
13. Location during the ride
During the ride the status page of your booking may show the last location of the car and the estimated arrival time. The location comes from the driver's phone and depends on reception and the device. It can be missing or delayed. It is an aid and not a guaranteed part of the service.
Anyone who knows the link to the status page sees this information. Pass the link on only to people who are allowed to see it.
14. Subscriptions and packs for garages
A monthly subscription includes a fixed number of rides in zone 1 per subscription month. The subscription month starts on the agreed start date. You pay the subscription in advance.
Each ride counts as one ride of the subscription; there and back are two rides. The pick-up day is what counts. Zones and surcharges that the subscription does not include are invoiced separately.
Unused rides expire at the end of the subscription month. With the Plus subscription up to 5 unused rides, and with the Pro subscription up to 10, move to the next subscription month if the subscription continues. They expire at the end of that month. There is no cash refund.
The Pro subscription includes the surcharge for urgent rides.
Money back in the first subscription month: if you end the subscription in its first month, you pay only for the subscription rides used that month, at CHF 65 each. We refund the rest of the price paid. This applies once per garage, to the first subscription.
Further rides in the same subscription month are invoiced at the price per ride of your subscription according to the price list.
Term and termination: the subscription renews for one subscription month at a time unless it is terminated. Minimum term: [MINDESTLAUFZEIT]. Notice period: [KÜNDIGUNGSFRIST]. You can give notice by email.
We may end a subscription with immediate effect for good cause, for example if payment is late despite a reminder. If we cannot carry out rides of a subscription month for reasons on our side, we credit them to the next subscription month or refund them pro rata.
Packs: a pack includes a fixed number of rides in zone 1. It is valid from the purchase date for the period stated in the offer. After that, unused rides expire.
Other benefits for garages: the first ride is free, and the second car on the same tour gets a 15 % discount. The partner discount of 10 % applies as long as the partner badge link is on your website. If the link is missing, the discount ends after 14 days.
15. Yearly subscription for private customers, newsletter discount and promotions
Yearly subscription: we no longer offer it. A yearly subscription already bought stays valid until the end of its term: it includes 4 rides in zone 1 and one additional service according to the price list and is valid for 12 months from the purchase date. While it is valid you get a 10 % discount on single prices. Zones and surcharges are invoiced separately. The yearly subscription does not renew by itself. Unused rides expire at the end of the term.
Newsletter discount: anyone who has confirmed their newsletter subscription gets, once per email address, a 10 % discount on their next private booking.
Promotions apply only during the stated period and on the conditions given with the offer.
16. Data protection
Our privacy notice explains how we process personal data. It is there to inform you and is not part of the contract.
17. Changes to these terms
A ride is governed by the version that was on this page when it was booked.
For running subscriptions we announce changes by email at least 30 days in advance. If you do not agree, you can terminate the subscription as of the date of the change. Without termination, the new version applies from that date.
18. Applicable law, place of jurisdiction and language
Swiss law applies.
The place of jurisdiction is Thun. For consumers, the mandatory places of jurisdiction are reserved, in particular that of their domicile.
If a provision of these terms is invalid, the others continue to apply.
These terms exist in German, Italian, French and English. If the versions differ, the German version prevails.
